What are the Obligations of the Only Representative?

The real or legal entity resident outside Turkey that manufactures the substance, formulates the mixture or produces the article must appoint a sole representative to carry out the necessary registration for substances imported into Turkey. If a ''Only Representative'' is appointed, the only representative is responsible for the registration.

► The Only Representative must prepare up-to-date Safety Data Sheets(SDS-GBF) for chemical substances.

► The Only Representative is responsible for all the obligations of importers for the substances for which they are responsible as registrant. These include not only the registration process but also other obligations under the KKDIK Regulation. 

► The Only Representative registers goods imported in quantities of 1 ton or more per year, either singly or in a mixture, depending on the contractual arrangements made between the “manufacturer located outside Turkey” and the only representative.

► If The Only Representative represents more than one non-Turkish manufacturer, it must register separately for each of these manufacturers.

► The Only Representative should keep a current list of the Turkish resident customers (importers) in the same supply chain as the “manufacturer outside Turkey” and the tonnage of each of these customers and the last update of the safety data sheet. 

► In the registration dossier, the Only Representative shall declare the importers resident in Turkey in the same supply chain as the “manufacturer outside Turkey”. 

If a “manufacturer outside Turkey” decides to change its Only Representative, the new Only Representative must update the information on the legal entity submitted to the Ministry.
